THE PROMOTION The title of the promotion is Fruit Shoot for the Moon. The promotional period will open daily from 08.00 GMT to 20.00 GMT (the “Promotional Hours”) on the 1st July 2023 (the “Opening Date”) until 30th September 2023 (the “Closing Date”) inclusive (the “Promotional Period”). To enter residents of Republic of Ireland only: Visit www.fruitshootforthemoon.com, answer the qualifying question correctly, confirm country of residence and complete the form (including name, email address, Dream Thing Category and confirmation their child is aged between 4 and 12 years old). Republic of Ireland entries may be subject to residency verification. Maximum of two (2) entries every 7 days per household per email address only, taken from day of first entry. Maximum of one (1) prize per household for the entirety of the Promotion. Anyone found attempting to bypass this rule by, for example, using multiple email addresses to enter will be disqualified. If you win one (1) prize, please do not continue to enter the prize draw, as you will not be eligible to win any further prizes. Entrants must have internet access to enter this Promotion. Purchase of Promotional Pack is necessary to enter the Promotion in UK only (no purchase necessary route available for residents of Republic of Ireland, see clause 4.7.1). UK entrants must retain their Promotional Pack and receipt as proof of purchase showing date of purchase during the Promotional Period and prior to date of entry. The Promotor, acting in its sole discretion, may request evidence of this before awarding any prizes. During the main Promotional Period, the 105 prizes will be randomly assigned to winning moments via an algorithm with prizes seeded over the Promotional Period. If your time of entry matches the guaranteed winning slot or you are the first person to enter after the time slot has passed, then you will be awarded the prize. If no entry is received between one winning moment and the next, the prize from that winning moment will be rolled over into the next winning moment and be available to be won then. No guarantee is given that all prizes will be won during the main Promotional Period. Any prizes unclaimed following the close of the main promotional period will be re-allocated to the mop up draw. Each family experience is for a family of four which is classified as EITHER 2 adults and 2 children or 1 adult and 3 children. See 5.5.11. for further detail. There are 105 prizes to be won over the entire Promotion. The Prizes are supplied by the Promoter and administered through its agents (the “Prize Administrator”) [...] The bespoke dream experience will be up to the value of £5,000, including agent, administration and any other booking fees, and cannot exceed this amount.The dream experience must fall within one of the following six categories: ARTS, CRAFTS & DRAMA; NATURE & SCIENCE; HISTORY & LITERATURE; MUSIC, FILM & ENTERTAINMENT; SPORTS & GAMES; TECHNOLOGY & TRANSPORT [...] Each winner in collaboration with their child may choose a destination and activities to make up their dream experience. The Prize Administrator will curate the winners’ desired destination and activities in line with budget and realistic practicality of the dream experience. All prizes subject always to availability and feasibility of chosen experience. Prize Administrator reserves right to amend any dream experience to ensure safety and suitability for all participants. Promoter and Prize Administrator not liable for unavailability of chosen dream experience. Once the prize details including dates, locations and (where applicable) activities are confirmed, this cannot be amended or altered by the winner. Any remaining amount not spent on travel, accommodation and activities will not be offered as a cash alternative. Each dream experience will be created and planned with the winner upon acceptance of the Prize. Destinations, dates and activities are subject to availability at the time of booking. Each dream experience must be booked within 3 months of prize acceptance and taken within 12 months of prize acceptance, unless the Promotor, acting in its sole discretion, agrees otherwise. Destination and preferred dates must be communicated a minimum of 6 weeks prior to proposed departure dates. Each winner and any accompanying guests may require passports valid past the date of proposed return. Each winner and any accompanying guests are responsible for any visas required to take the prize. If any winner/guests are unable to obtain a visa, the Promoter is not liable. [...] Unless otherwise stated or arranged with the Prize Administrator, all expenses incurred by the winners in the general use and/or enjoyment of any prize, including but not limited to food, drink, travel and accommodation, are the sole responsibility of the winners. Family Experience winners will then need to select their chosen family experience. All winners will receive a winning confirmation email (the “Winning Confirmation Email”), sent to the email address provided at the time of entry. It is the responsibility of entrants to check junk/spam folders to ensure they are in receipt of any communications. Further detail below: Dream Thing Prizes: each winner will be contacted via the email address provided on entry within 7 days of the Winner Confirmation Email being sent and will be required to respond via email within 14 days to confirm eligibility, postcode and acceptance of the prize. UK entrants may (at the Promotor’s sole discretion) also be required to provide a copy of the itemised till receipt(s) that was issued when the Promotional Packs were purchased and their Promotional Pack. They will then have their dream experience curated from a category of ARTS, CRAFTS & DRAMA, NATURE & SCIENCE, HISTORY & LITERATURE, MUSIC, FILM & ENTERTAINMENT, SPORTS & GAMES, TECHNOLOGY & TRANSPORT within 28 days of confirmation acceptance and the completion of verification. Receipt may not be returned so please ensure a copy is taken before sending. Family Experience Prizes: each winner will be contacted via the email address provided on entry within 7 days of the Winner Confirmation Email being sent with further details on the prize they have selected curated from a category of ARTS, CRAFTS & DRAMA, NATURE & SCIENCE, HISTORY & LITERATURE, MUSIC, FILM & ENTERTAINMENT, SPORTS & GAMES, TECHNOLOGY & TRANSPORT. Winners must respond within 14 days via email to confirm eligibility and accept their prize. Verification of winner and child’s age, identity and address will be required within 10 working days of prize acceptance before any prizes are awarded.Winners have 14 days from receiving the Winner Confirmation Email to confirm eligibility and acceptance of their Prize via email and provide a postcode if requested. In the event that a winner does not respond to the initial contact within 14 days, the Promoter reserves the right to disqualify that winner. If a winner is disqualified or is ineligible, the Promoter reserves the right to re-allocate any unallocated prizes via a mop-up draw, see clause 6.7. below. All requested details must be provided otherwise the Promoter reserves the right to reallocate the prize with no liability. The Promoter does not accept any responsibility in the event a winner does not, or is not able to, take up their prize. Mop up draw for all unclaimed prizes from the promotional period to take place on 18th October 2023 (the “Draw Date”) via a randomised computer process. All unsuccessful entries received in the Promotional Period will be entered into the mop up draw. Winners will be notified by email within 7 days of the Draw Date and will be required to respond within 14 days of this initial notification to confirm eligibility and acceptance of the prize. Winners of Dream Thing Prizes will be required to provide a postcode. In the event a winner does not respond to this notification within 14 days of initial contact, the Promoter reserves the right to select an alternative winner from all remaining entries, with the originally selected winner forfeiting their right to the prize. It is the responsibility of entrants to check junk/spam folders to ensure they are in receipt of any communications. The process will repeat for 3 months after the mop up draw until an eligible winner is able to claim the prize. At the end of the 3 months, all remaining prizes will become null and void. PRIZE DELIVERY Please allow 28 days from valid acceptance and the completion of verification for the Dream Thing Prizes to be organised with the Prize Administrator. Delivery of the Family Experiences prizes will vary per experience chosen, further detail to be provided on acceptance of prize. If any prizes are unable to be organised due to inaccurate details or delay on the part of the winner, the Promoter reserves the right to withdraw and reallocate the prize entitlement with no liability. If delivery will be delayed due to the Covid-19 pandemic and resulting Government restrictions all winners affected will be contacted by the Promoter or the Prize Administrator and kept updated of any unavoidable changes and revised delivery dates. LIMITATION OF LIABILITY Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected. For the avoidance of doubt, this clause 8.1 shall also apply in respect of any prize provided by a third-party provider, in this case the Prize Provider. DATA PROTECTION By entering the promotion, you agree that any personal information provided by you with the promotion entry may be held and used only by the Promoter or its agents and suppliers to administer this promotion. Entrant data will be deleted on 18th January 2023. All winner data will be deleted 3 months after an experience is taken. The Promoter will make available a list of UK Dream Thing Experience winners’ surnames and counties of residence to members of the public or regulators who request such details within 3 months of the closing date of this Promotion. Entrants can object to disclosure, or request that disclosure be limited in scope by emailing britvicteam@getsavvy.com. We reserve the right to refuse any or all such requests. GENERAL By entering the Promotion, all entrants hereby grant the Promoter (or the Promoter’s designee) the exclusive right to film, tape, sound record and photograph all their activities in connection with the Promotion and (if applicable) any prizes. Everything filmed, taped or recorded by the Promoter (or the Promoter’s designee) shall be known as “Footage”. All entrants hereby irrevocably and unconditionally assign to the Promoter with full title guarantee (and by way of present assignment of present and future rights) all intellectual property rights in any “Footage” throughout the world for the full unexpired period of such rights and all renewals, reversions and extensions of such period as may be provided under any applicable law throughout the world. Instructions provided at the point of entry form part of the Terms and Conditions of this Promotion. In the event of a conflict, these terms and conditions take precedence. The Promoter reserves the right to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant if the Promoter has any reason to believe that there has been a breach of these Terms and Conditions, or if it has any reason to believe that efforts have been made to distort the competitive process or spirit of the Promotion or otherwise where a participant has gained unfair advantage in participating or won using fraudulent means, the Promoter may, at its sole discretion, reserve the right to exclude any entrant from participating in the promotion. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions (including but not limited to global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God), the Promoter will not be liable for any failure to perform or delay in performing its obligations. It is the responsibility of the entrant to provide their correct, up-to-date details when entering the Promotion and/or confirming acceptance of the prize in order for their prize to be processed. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize. The Promoter has no control over communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the Promotion. If any clause or provision of these Terms and Conditions is declared by a court to be illegal, invalid or unenforceable, this declaration shall not affect the validity and enforceability of any other clause or provision within. Entrants acknowledge that other entrants may submit entries that may be similar to theirs, and that they will not be entitled to any compensation or right to negotiate with the Promoter over such matters. The Promoter reserves the right to, at its sole discretion, disqualify any entries containing: (a) content deemed to be wholly inappropriate, discriminatory or illegal, including but not limited to obscene, indecent, defamatory, malicious, racist, sexist, homophobic, harassing, threatening and/or offensive, inclusive of nudity and/or pornography, sexual, violent and fraudulent in nature. (b) any activity or behaviour which causes, encourages or promotes danger or a threat to the health and safety of the entrant and/or others. (c) any activity or behaviour which promotes or advertises goods and/or services, including competitor products, for any form of remuneration. (d) any attempt to impersonate another person or include persons who have not given permission to feature in the entry.
