Please read these Terms and Conditions (the “Terms”) carefully. You will be legally bound by these Terms from the time you submit an entry for the Asda Batman Batchelors Text to Win promotion (the Promotion). The Promoter and the Agency 1. Premier Foods Group Limited of Premier House, Centrium Business Park Griffiths Way, St. Albans, United Kingdom, AL1 2RE is the “Promoter”. 2. Blue Chip Marketing Ltd, Blackfriars House, Parsonage, Manchester M3 2JA is the “Agency”. Eligibility 3. The Promotion is open to GB residents (England, Wales & Scotland) aged 18 or over. This promotion excludes the agents (including the Agency) and employees of the Promoter and its group companies, the families of such agents and employees, or anyone professionally connected with the Promotion or its administration. 4. Entrants may need to provide proof of name, age and address to validate that they meet the entry requirements and can accept the Prize. 5. Entries accepted by text message only. Valid mobile number required. Ask bill payer’s permission before entering. Texts will be charged at network provider’s standard rate. Internet access and valid email address required. No purchase necessary. How to Enter 6. The Promotion will begin at 00.00 on 14th September 2023 and close at 23.59 on 25th October 2023 (the “Promotion Period”) The Promotion will consist of one prize draw at the end of the Promotion Period. 7. To enter, text BATMOBILE and your email address to 60777 during the Promotion Period. 8. All entries must be received by the Promoter by no later than the closing time and date. All entries received after the Promotion Period are automatically disqualified. 9. There shall be a maximum of four entries per mobile number and email address and a maximum of one prize per mobile number and email address. Entries made through agents, third parties, organised groups, in bulk or any entry duplication method will not be accepted. 10. No purchase necessary. Texts will be charged at network provider’s standard rate. Ask bill payer’s permission. Selection of the Winners 11. Within 7 days after the closing time of the promotional period, 101 winners (the “Winners”) will be selected at random via a computer-generated randomizer, under the supervision of an independent observer, from all of the eligible entries for each available prize (see clause 12 for list of available prizes below). Prizes will be randomly allocated to each randomly selected Winner, via the computer-generated randomizer. The Prize 12. Each of the 101 Winners will be randomly awarded one prize from the following available prizes: Main Prize • 1x £5000 cash prize (payable by BACS transfer to a UK bank account only). Runner Up Prizes • 10x £20 cinema e-gift cards; • 10x £20 Asda e-gift cards; • 50x Batman mugs; and • 30x Batman logo t-shirts. 13. The Prizes are not negotiable or transferable. 14. Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value should circumstances make this necessary. Winner Announcement and Delivery of the Prize 15. The Winners will be contacted by the Agency via the mobile number used by the entrant to enter within 14 days of the closing date (the “Notification Date”). Entrants who have not won a prize will not be notified. Winners will be asked to provide their details to enable the Agency to deliver the prize to the Winner. Winners will have 14 days from the Notification Date to provide the requested details. The Agency will make reasonable endeavors to contact a winner (three phone calls, text messages or emails). If the Agency is unable to contact you or, if you do not claim the Prize and provide your details within the time period specified in this clause, your claim will become invalid. The Promoter reserves the right to offer the prize to the next eligible entrant selected from the remaining valid entries in the relevant draw that were received in accordance with these Terms, should a Winner’s claim become invalid or, if the Winner cannot accept the Prize for any reason. 16. The Winner or, an individual aged 18 or over nominated by the Winner, may be required to be available at the delivery address to accept and sign for delivery of the prize. 17. The Winner will be required to hold a UK bank account for the purpose of receiving the cash prize, which will be paid by BACS transfer. Data Protection and Marketing 18. By entering the Promotion, each entrant agrees that any personal information provided by them with their entry may be held and used by the Promoter or its agents (including the Agency) and its suppliers for the purpose of administering the Promotion (including for contacting winners, prize fulfilment and dealing with any consumer queries regarding the Promotion). Please see the Promoter’s Promotion Privacy Notice (below) for full details on how your data will be handled and processed and for information about your rights. 19. The Winner may be required to take part in non-paid publicity or advertising relating to the Promotion, which may include having their photograph taken for promotional and press purposes. The Promoter may use the Winner’s surname and county of residence to announce them as the Winner of the Promotion. If you do not wish for your personal information to be used for this purpose or, if you wish to limit the amount of personal information that is published, please contact: privacy@premierfoods.co.uk 20. To receive a list of Winner(s) and county of residence of the Winner(s) contact the Promoter’s care team by calling 0800 032 7111 or by completing the “Contact Us” form on the Promoter’s website: www.batchelorsrange.co.uk. Requests must be made within 3 months of the Closing Time. Please note that we may not be able to disclose this requested information if an entrant objects to the disclosure of such information in accordance with clause 18. Where a winning entrant has objected to their information being disclosed, the Promoter or the Agency will instead confirm that a valid award has taken place. Limitation of Liability 21. Insofar as is permitted by law, the Promoter, its agents (including the Agency) or distributors will not in any circumstances be responsible or liable to compensate the Winner(s) or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected. General 22. Any entries that do not comply in full with these Terms and the applicable terms set out in this clause will be disqualified. 23. Any decision of the Promoter as to eligibility to take part in the Promotion or the result of the Promotion will be final and no correspondence or discussion will be entered into. The Promoter accepts no responsibility for entries that are incomplete, delayed, lost, damaged or unreadable whether due to failure or non-availability of the website, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind, or the submission of incomplete information or any other reason. 24. The Promoter reserves the right to delay, postpone or cancel the Promotion in the event of circumstances outside its reasonable control, which it considers necessary. 25. The Promotion and these Terms are subject the laws of England and Wales. Any disputes must be referred to the English courts. 26.
