Maltesers Bunny Capital Breakfast Promotion on Capital Network, excluding Scotland, February - March 2024 – Specific Rules 1. The Maltesers Bunny Capital Breakfast promotion (‘Promotion’) is organised by Global (as defined in the General Terms and Conditions). The Promotion will run from Tuesday 13th February 2024 to Sunday 25th February 2024 on the Capital Network, excluding Scotland. Global is the Promoter. The ‘Promotion Partner’ mentioned in these Specific Rules is Maltesers and the ‘Prize Provider’ is NDL. 2. IMPORTANT: The Promotion is subject to these Specific Rules and the General Terms and Conditions which are available here (together, the ‘Promotion Terms and Conditions’). Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions. Details of the Promotion: 3. There are two stages to this Promotion, as outlined below: STAGE ONE: 4. To enter the Promotion, you must: a. go online to the Promotion entry page at capitalfm.com/win and register your details. b. in 300 characters or less explain your ‘funny failure’ in the free text box on the Promotion page (your ‘Submission’). 5. Online entry will open at 17:00 on Tuesday 13th February 2024 and close at 23:59 on Sunday 25th February 2024. Entries received before or after this time will not be included in the Promotion. 6. Within 24 hours of the closing time of the Promotion, all eligible entries will be entered into a draw. 20 entries will be selected at random to form a shortlist. 7. The shortlisted 20 entries will be judged by a panel of judges including one independent judge on the following criteria: how a) entertaining, b) how personal it is to the entrant and c) how creatively and independently unique your Submission is. The panel will score each entry based on these 3 criteria. The top 5 scoring entries will be selected as winners. 8. Entries deemed by us to be rude, offensive, defamatory, illegal, including alcohol, excessive consumption, gambling or condoning dangerous behaviour will be removed from the Promotion. 9. By submitting your entry to this Promotion, you confirm that you have obtained the consent of all individuals that feature in your submission (in the case of children under the age of 18, you have obtained the consent of the child’s parent/guardian) and agree to notify us immediately if their consent is withdrawn at any time. 10. If none of the 20 shortlisted entries are deemed to meet the stated criteria, another 20 entries will be drawn at random, then judged against the above criteria and ranked to determine the top five as above. 11. The top five ranked winning entries will be awarded ‘Prize A’ as outlined in clause 26 They will be contacted via phone call on Monday 26th February 2024 between 09:00 and 17:30, and informed of their win by one of our representatives via the telephone number with which they registered to enter. If any of the five winners do not respond within 3 attempts to contact them, they will forfeit their right to Prize A and we shall be entitled to select the next highest ranked entry from the shortlisted and judged 20 entries. 12. The top five ranked winning entries will then be judged against a 4th criteria: how relevant to the Capital audience your Submission is, to determine the top two ranked winning entries. 13. For the avoidance of doubt, the remaining 15 judged entries will not receive a prize. 14. The top two ranked out of the five winning entries (‘the Finalists’) will be required to come to air on Friday 1st March 2024 between 06:00-10:00 to share their story via a phone call with the presenters, and be in with the chance to win ‘Prize B’, as detailed in clause 26. The call will be pre-recorded before being played out live on air that day. There will also be a call with the producer of the Capital Breakfast show and the Finalists on Thursday 29th February 2024 between 09:00-12:00 to prepare and brief the Finalists ahead of the final Promotion round on Friday 1st March 2024, Finalists are required to be available during these times. 15. If either of the two Finalists do not respond within 3 attempts to contact them or cannot participate in the phone calls with the Producers or Presenters, they will forfeit their right to win ‘Prize B’ and we shall be entitled to select the next ranked finalist to play for the chance to win ‘Prize B’. 16. If you are a Finalist, you must answer your telephone when we contact you. Someone else cannot answer the phone, participate or accept a prize on your behalf. If: (i) you fail to answer the phone; (ii) someone else answers the phone; (iii) the call goes to voicemail; (iv) the call becomes disconnected; (v) you are not (or do not seem to us to be) in a position to safely and/or lawfully take or remain on the call (for example, if you are or seem to be driving); or (vi) you are not audible or intelligible or we are not able to conduct a conversation with you in a manner that is suitable for broadcast for any reason beyond our control (including, but not limited to: low/no signal on your device, a call is dropped by any network, you are travelling, there is too much background noise or feedback, etc.); before or during the Promotion, you may be disqualified and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable. If you have complied with all applicable terms and conditions, and successfully received more ‘listener votes’ than the other Entrant (including correctly answering any questions and/or successfully completing any tasks, as applicable) then you will be declared the winner of the Promotion. STAGE TWO: 17. On Capital Breakfast on Friday 1st March 2024 between 06:00 – 10:00, the presenters will play out the stories from each of the two Finalists. 18. Once both stories have been revealed on air, listeners will be asked to choose which Finalist deserves to win ‘Prize B’. To enter, listeners must text in the word WIN followed by either ‘A’ or ‘B’ to 83958 (the ‘Text Message Line’). The opening and closing times of the Text Message Line will be given out on air by the presenters. 19. Once the Text Message Line has closed, all eligible votes will be counted. The Finalist who has received the most votes will then be declared the winner of the Promotion and will win ‘Prize B’ as stated in clause 26. 20. By placing a vote for a Finalist to win, entrants are eligible to win 'Prize C’ as detailed in clause 26. Once the Text Message Line has closed, all eligible entries that have voted will be entered into a draw and one entrant will be selected at random to win ‘Prize C’ as stated in clause 26. The winner will be contacted on Friday 1st March 2024 and informed of their win by one of our representatives via the telephone number with which they entered the Promotion. 21. We, the Promotion Partner and the Prize Provider may publish and publicise the two Finalists’ submission, name, image, social media handle and/or profile picture, their nearest geographical location (for example, their nearest city, town or county) and their entry, and we may refer to their and any applicable third party’s (for example any one included in the submission/a guest/a travel companion) association with the Promotion and/or the prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Promotion. 22. In relation to the Finalists (and runners up if applicable), you understand that we and our Promotion Partner may: (i) interview you and your guest(s)/travel companion(s) which we may film, photograph and/or record and; (ii) film, photograph and/or record, you and your guest(s)/travel companion(s) in connection with the Promotion, either by telephone or in person, and we may use such films, recordings and/or photographs for publicity and PR purposes in any and all media, worldwide, as often and for as long as we consider appropriate or desirable, in connection with the Promotion. We may also publish your and your guest(s)/travel companion(s) name, image, social media handle and/or profile picture. Eligibility: 23. Entry is restricted to one entry per person; duplicate entries will be excluded from the Promotion. Prizes: 26. The Prizes for this Promotion will be split into ‘Prize A’, ‘Prize B’ and ‘Prize C’ as detailed below: Prize A: The five winning entrants will each receive 30 Maltesers Bunny chocolates. This prize will be delivered to the winners within 28 days of them providing full delivery details to the Prize Provider. Prize B: One winning entrant will receive a prize up to the value of £3,000 which is in the theme of and connects to their ‘funny fail’ story that they submitted to the Promotion. Prize C: One entrant will receive 30 Maltesers Bunny chocolates. This prize will be delivered to the winner within 28 days of them providing full delivery details to the Prize Provider. 27. The prize is non-transferable and non-refundable. No cash alternative is available except at our sole discretion. 28. We reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion. 29.
