Terms & Conditions

Promoter and Data Controller: Freixenet Copestick Limited, 2100 First Avenue London Road, Newbury, Berkshire, RG14 2PZ.

1. Promotion is open to residents of the United Kingdom who are aged 18 or over, except employees of the Promoter (Freixenet Copestick Limited), their immediate family members or anyone professionally associated with this promotion.

2. Purchase and internet access are required.

3. Maximum one entry per person, maximum one prize per person.

4. Promotion Period: The Promotion opens at 00:01 on 1 May 2024 and closes at 23:59 on 31 December 2024.

5. To participate: To participate purchase a promotional bottle of Freixenet Cordon Cava. Visit winwithfreixenet.co.uk and enter the unique 8 digit code printed inside the promotional neck hanger on the bottle along with your full name and valid email address. All entries received during the Promotion Period will be submitted into the prize draw. Promotional bottles are subject to availability and whilst stocks last.

6. Each 8-digit code is unique and can only be used once. Any attempts to enter the same code more than once, to use codes from non-promotional packs, or to use any codes not intended for use in this promotion, may result in disqualification and all such entries will be declared void.

7. Prizes: There are 50 Prizes, as follows:

a. 1 x 5 night trip for 2 to Barcelona. Prize includes economy return flights from a major UK airport, double or twin accommodation at a minimum 4-star hotel with daily breakfasts and private transfers to and from Spanish airport. Prize also includes Freixenet winery tour with lunch, 3-day Barcelona sightseeing pass, private half-day yacht cruise, 20-minute helicopter tour (if winner or guest weighs over 120kg winner can pay for an additional seat or not use this portion of the prize, to advise on confirming trip dates), cocktail experience (dress code applies), nine-course tasting menu at top Barcelona restaurant (dress code applies). Transport for excursions (except sightseeing pass) is provided. Winner will also receive £1,000 spending money. Basic travel insurance is included but winner should check the cover provided and obtain additional insurance if required. Prizes to be booked and taken by 31 December 2025 and may not be taken between 21 December 2024 and 2 January 2025, Easter Sunday or UK bank holidays. Winner and guest must be minimum 18 years old at time of trip. The trip must include a Saturday night and winner must select 3 different trip dates in three separate months no later than 6 weeks before the first of such dates and prize provider will confirm which set of dates the trip will be (from the provided list);

b. 2 x Spa days for 2 at your choice of participating spa. Includes full day of access to pool, sauna, steam room and jacuzzi (as applicable to your chosen spa), and one treatment per person (inclusive spa treatment range will vary depending on spa facility), and £50 per person towards lunch at the spa restaurant. Prizes to be booked and taken by 31 December 2025 and may not be taken between 21 December 2024 and 2 January 2025, Easter Sunday or UK bank holidays. Winner and guest must be minimum 18 years old at time of trip. Transport is not included;

c. 5 x Freixenet Cordon Cava-themed hampers with contents worth approximately £100;

d. 10 x £50 ASOS voucher and bottle of Freixenet Cordon Cava. ASOS voucher is subject to the terms and conditions here (under “gift cards”) and must be used within 2 years of date of issue; and

e. 32 x pair of Freixenet Copestick branded flutes and bottle of Freixenet Cordon Cava.

8. Prizes are not transferrable and cannot be exchanged for cash. In the event of unforeseen circumstances, the Promoter reserves the right to substitute a prize, or part of a prize, for an alternative of equal or greater value.

9. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on acceptance of their prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

10. Winner Selection: All valid entries received before the end of the Promotion Period will be submitted into a prize draw to be conducted by or under the supervision of an independent body within 5 working days of the end of the Promotion Period. 50 winners and 50 reserves will be selected at this time.

11. Winner notification: The provisional winners will be notified within 5 working days of the winner selection by email to the email address associated with the winning entry. Winners must respond to the initial communication within 10 working days confirming compliance with these terms and conditions and eligibility (residency, proof of age). If a winner does not comply with this timeframe they will be disqualified and a reserve winner will be contacted.

12. Unclaimed Prize: If, despite the best efforts of the Promoter, a prize remains unclaimed after offering to at least two reserve winners, the Promoter shall not be obliged to allocate the prize but may withdraw it from the promotion and use it as it sees fit.

14. Further Prize details: All voucher prizes will be delivered by email within 7 days of winner confirmation. All physical prizes will be delivered by post or courier within 28 days of winner verification.

a. Barcelona Trip:

i. The winners and guests are responsible for ensuring that they are in possession of appropriate travel insurance, valid passports (minimum 2 clear pages, minimum 6 months’ validity from proposed date of return), visas and all health or other Government requirements prior to departure;

ii. Winner might be required to provide credit card details to be held by the hotel as guarantee against any in-room spending;

iii. Basic travel insurance is included but winner is advised to check the level of cover is appropriate and acquire additional insurance if needed;

b. Barcelona trip, Spa days:

i. Winner and guest must be over 18 years of age at time of travel;

ii. Travel bookings will be made via the Promoter’s nominated agency and must be made at least 6 weeks in advance of proposed dates;

iii. All travel is subject to the relevant transport provider’s standard terms and conditions. Once booked, flights and train tickets cannot be altered or amended and no refunds are possible;

iv. Once a booking has been confirmed no changes are permitted;

v. If a booking is cancelled no alternative prize will be issued;

vi. Once booked, transport tickets cannot be altered or amended and no refunds are possible;

vii. Prizes cannot be used in conjunction with any loyalty programme, any other discount, discount coupon(s) or voucher(s), promotion(s) or special offer;

viii. Once the prize has been booked, neither the Promoter, nor the prize agency nor any provider of any element of the prize shall be liable for any failure to comply with its obligations caused by (but not limited to) weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, or any other circumstances beyond the control of the Promoter or travel companies; and

ix. All expenses not explicitly set out in these terms and conditions will be the responsibility of the winner.

c. All prizes:

i. Winners will be required to provide proof of age and identity and any documentation as reasonably required by the Promoter in order to validate their eligibility to claim the prize;

ii. If a winner is unable to accept the prize, no compensation or alternatives will be provided; and

iii. The Promoter is not liable for third party products or services and prizes are subject to the prize supplier’s terms and conditions.

15. A winner who is over 25 may be requested to participate in publicity arising from the promotion, although for regulatory reasons if a winner looks under 25 the Promoter will withdraw the request.

16. Privacy: The details you provide when entering this promotion, namely your email address, will be held by the Promoter under the terms of its privacy policy, available at https://freixenet.com/uk/privacy-policy/ and https://freixenet.com/uk/cookie-policy/. Your personal data will be used by the Promoter and its agents acting on their behalf only for the operation of this promotion. The Promoter is bound by the UK Data Protection Act 2018 and all applicable laws. Your personal data will be stored for 3 months from the end of the Promotion Period, after which it will be deleted. 17. The surname and county of residence of the winners of the Barcelona trip and the 5 x Spa days will be available by sending an email to hello@winwithfreixenet.co.uk with “Freixenet 50th anniversary winners” in the subject header to arrive between 1 January and 31 March 2025. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting hello@winwithfreixenet.co.uk. In any case, if a regulatory body requests confirmation of the existence of winners, or evidence of receipt of prizes, the Promoter shall be entitled to disclose the information of any winner to the regulatory body only.

18. Entries (bulk or otherwise) made from trade, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the draw in a way that is not consistent with the spirit of the promotion, that person’s entries will be disqualified and any prize award will be void.

19. The Promoters reserve the right to verify any claimant, including their age (via means of photographic identification), before awarding a Prize and refuse to award the Prize or withdraw Prize entitlement where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion.

20. Incomplete, illegal, misdirected or invalid entries, or entries not in accordance with these Terms and Conditions will not be accepted. Proof of sending will not be accepted as proof of delivery.

21. If for any reason the Promotion is not capable of running as planned for reasons beyond the control of the Promoter (including but not limited to tampering, unauthorised intervention, fraud, technical failures) which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion), the Promoter reserves the right (subject to any written directions given under applicable law) to modify or suspend any relevant element of the Promotion as it deems necessary with no liability to entrants or third parties. In these circumstances the Promoter will not be liable for any failure to perform or delay in performing its obligation.

22. The Promoter cannot accept any responsibility for any damage, loss, injury suffered by any entrant entering the promotion or as a result of accepting any prize. Nothing in this clause shall limit the Promoter’s liability in respect of: (a) death or personal injury arising out of its own negligence; or (b) liability arising out of the Promoter’s fraud.

23. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

24. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise. The Promoter is not liable for any problems associated with internet or communication networks due to traffic congestion, technical malfunction or otherwise.

25. The Promoter is not liable for any damage to prizes sent to winners once the prize has been handed to the delivery service, or delay or non-delivery of prizes caused or affected by postal disputes.

26. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

28. These terms and conditions are governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English and Welsh courts unless you live in another part of the United Kingdom, in which case your local courts will have jurisdiction.
