Terms & Conditions

Entry instructions are deemed to form part of the terms and conditions and by participating in the Promotion all entrants will be deemed to have accepted and be bound by these terms and conditions.

1. This Promotion is open to residents of United Kingdom (UK) and Republic of Ireland (ROI), aged 18 years or over except employees and their immediate families of the Promoter, their agents or anyone professionally connected with the Promotion.
2. These Terms and Conditions will be available at winwithfrubes.co.uk/terms.
3. Internet access, a valid email address, mobile phone number and smartphone required for entry. Purchase necessary in UK only. Retain receipt. No purchase necessary in Republic of Ireland.
4. Opens for entries at 00:01 on 31st December 2024 and closes for entries at 23:59 on 1st March 2025. Entries received outside of this time will be void and will not be entered into the Promotion.
5. The Promotion is limited to one entry per person, per email address and mobile number, per day. Maximum of 1 instant win prize per person in total throughout the promotional period.
6. To enter the Promotion, you must purchase a qualifying pack of Frubes featuring the promotional flash, scan the QR code on pack or visit winwithfrubes.co.uk and select which territory you are entering from (UK or ROI).
7. For the UK territory: Enter your details, including full name, email address, mobile number, postcode and your barcode from pack to find out instantly if you are a winner of an instant win prize. All valid entrants will also be entered into the prize draw for the chance to win a trip to Tokyo, Japan.
8. For the ROI territory only: free entry route. Enter your details, including full name, email address, mobile number and postcode to find out instantly if you are a winner of an instant win prize. All valid entrants will also be entered into the prize draw for the chance to win a trip to Japan.

10. Prizes:
    1. Instant Win: There are 1,000 instant win prizes and the total promotional pack universe is 3,260,720 across UK and ROI. Each prize is a £/€100 eVoucher for one of the specified retailers (Amazon.co.uk Gift Card, JD Sports or Sports Direct). UK winners will be able to choose their preferred eVoucher provider from either Amazon.co.uk Gift Card, JD Sports eVoucher or Sports Direct eVoucher. ROI winners will be awarded a €100 Amazon.co.uk Gift Card. The currency will be determined by the country you reside in. Winners in ROI will be able to claim a €100 eVoucher, winners In UK will be able to claim a £100 eVoucher.
    2. Prize Draw: There is 1 prize draw prize available to be won. The prize is 1 x trip to Tokyo, Japan for 4 people (2 adults and 2 children aged 15 and under).

    The Prize Draw is shared between UK and ROI.
11. Each prize or element of each prize may be subject to its own terms and conditions and in order to redeem the prize and entrants agree to be bound by them.
12. Instant win winners will be determined by a secure and automatic computer-generated algorithm that produces verifiably random results. Each entrant’s chance of winning is based on the promotional volume of 3,260,720 vs the number of prizes to be given away at the start of the Promotion. The chance of winning is 1 in 1,630. The percentage chance of winning will not decrease across the promotional period. The number of prizes will be (statistically) dependent upon participation rates. Wins will be allocated independently by the system using an algorithm. Although all prizes are available to be won, there is no guarantee that they will all be won.
13. Entrants will be notified immediately on screen if they have won an Instant Win prize. Winners will also receive an SMS within 14 days confirming their win, along with a link to claim their prize. UK Winners will be required to complete the claim form with their personal details and upload an image of their original itemised till receipt/online order confirmation in order to claim their prize. Receipts must pre-date and time their winning entry. Winners that do not complete the claim form within 14 days of sending will forfeit their prize. ROI Winners will be required to complete the claim form with their personal details in order to claim their prize.
14. It is the responsibility of the entrant to ensure that they have accurately provided a valid mobile number to ensure they are in receipt of promotional communication within 14 days of it being sent.
15. The winners of an Instant Win prize will receive a link to redeem their eVoucher via SMS to the mobile number provided upon entry within 28 days of a valid prize claim.

This tour eliminates the guesswork by taking you the best of the neighbourhood’s stores, cafés, and more where you can soak up the atmosphere. This tour includes lunch.
18. The prize is valid for travel for 12 months from the date of winning excluding travel over Christmas (25th December 2025 – 1st January 2026), Easter (18th April 2025 – 21st April 2025) and all UK public holidays 5th May 2025, 26th May 2025 or 25th August 2025). All travel must be completed within 12 months from the date of winning. Extensions to the validity of the prize will not be allowed unless first authorised by the Promoter.
19. The Prize Draw winner will be electronically drawn at random by an independent third party from all valid entries correctly submitted in accordance with these terms and conditions within 7 days of the close date of the Promotion. An appropriate number of reserves will be drawn at the same time as the winner. The winner will be notified by phone to the mobile number provided upon entry within 7 days of the prize draw. Contact will be attempted a maximum of 3 times across 7 days before the prize is deemed unclaimed and is reallocated to a reserve. A maximum of 3 reserves will be contacted in the order they were drawn if the prize remains unclaimed after 7 days.
20. All holiday locations and dates are subject to availability. Travel will be subject to flight and hotel availability at the date of booking the trip. The winner should notify the Promoter at least six weeks in advance of their preferred dates for taking the trip.
21. The Promoter will accept no responsibility for hotels/ tours/ transport companies etc. being withdrawn or amended. In the event of this, the Promoter’s Prize provider will endeavour to offer a suitable alternative. The Promoter is not responsible for changes in schedule or for any expenses incurred as a consequence of flight cancellation/delay.
22. Any amendments made by the prize winner after the booking is confirmed may be subject to administration charges levied by the specific supplier.
23. Please note that the Prize does not include any travel costs, meals and beverages, personal expenses, additional activities or any other expenditure not explicitly detailed in clause 10(b). Travel to and from the winner’s location to the UK airport are the responsibility of the winner. The Promoter is not responsible for any expenses incurred.
24. The winner is responsible for the behaviour of themselves and their guests whilst enjoying the Prize. The Promoter reserves the right in its absolute discretion to exclude the winner and/or guests from utilising the Prize if the winner and/or their guests fail to comply with the directions of the Promoter or any companies associated with the Prize or the winner and/or guests act in a manner that is dangerous to themselves or to the public or is anti-social in any manner or which causes a disturbance or nuisance to others.
25. The winner and their guests are responsible for ensuring that they all have a valid passport, are eligible for any applicable visa waiver programme or are in possession of a valid visa, as appropriate, and for ensuring that they have all necessary travel and medical insurance (prior to travelling and at all times during the period of travel) and any vaccinations as required. They are also responsible for all costs, including taxes for any costs incurred beyond the Prizes.

General

26. All entries must be made by the entrant themselves. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, entries made by macros or other automated means (including systems which can be programmed to enter) and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of 'script', 'brute force', masking their identity by manipulating phone numbers or IP addresses, using identities other than their own or any other automated means in order to increase that entrant's entries into the Promotion in a way that is not consistent with the spirit of the Promotion, that entrant's entries will be disqualified and any prize award will be void. Prizes allocated to winners who are subsequently disqualified may not be reallocated.
27. The Promoter reserves the right to substitute a prize for an equivalent or greater value should the original prize offered become unavailable for reasons beyond the Promoter’s control.
28. Winners may be requested to participate in reasonable publicity arising from the Promotion with no further compensation.
29. The prize draw winner’s surname and county are available by sending a correctly stamped self-addressed envelope to Frubes Japan Instant Win 2024 (8277), PO Box 906, Chilton, Aylesbury HP22 9HR within three months of the closing date. By entering the Promotion, each entrant acknowledges that if they are a winner their surname and county may be disclosed to persons enquiring, where permitted by law. A winner may object to their information being made available in this way or may request that the amount of information made available be reduced, by contacting the Promoter. In these circumstances the winner acknowledges that the Promoter may nevertheless disclose such information in full upon request from such competent authorities (including without limitation the Advertising Standards Authority).
30. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, or reasonable belief to suspect collusion to subvert the terms of this Promotion, and/or an error (human or computer) affects or could affect the proper operation of this Promotion, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the Promotion or these terms and conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
31. The Promoter reserves the right to verify the eligibility of all entries to protect itself against fraudulent, invalid or repetitive entries including but not limited to asking for address and identity details (which they must provide within 14 days) and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.
32. The Promoter does not accept responsibility for entries lost, damaged or delayed or as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.
33. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
34. The Promoter will not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances of the Promoter.
35. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
36. The Promoter’s decisions regarding all promotional matters shall be final and no other correspondence will be entered in to.
37. The Promoter will collect and process certain personal information, in compliance with the regulation in force regarding protection of personal data, from entrants which, by taking part in the promotion, the entrants’ consent to. The Promoter will only use the personal data for the purposes of carrying out the Promotion and, if your consent is obtained, to send you emails containing news and offers from Frubes and for no other purpose, unless the Promoter obtains your consent. However, personal data supplied during the course of the Promotion may be passed on to third party supplier only insofar as required for fulfilment/delivery/arrangement of the Promotion. The personal details will at all times be kept confidential and in accordance with the UK General Data Protection Regulation (UK GDPR). Any person concerned who can prove his or her identity has a right of access, rectification, deletion, opposition, portability of personal data concerning him or her and limitation of processing. Entrants in the Promotion may exercise these rights by sending a written request, enclosing proof of identity, by registered post with acknowledgement of receipt, to the Sodiaal Group's Data Protection Officer: annabel.francony@sodiaal.fr. The data collected is compulsory in order to take part in the Promotion. Consequently, persons who exercise their right to delete their personal data before the end of the Promotion will be deemed to have waived their right to participate and to receive a prize. The Promoter will delete the personal data collected for the management of the Promotion three months after the end of the Promotion. If applicable, the personal data collected may be kept for a longer period in accordance with specific legal obligations or in the event of dispute.
38. This Promotion is governed by English Law and the courts of England and Wales will have exclusive jurisdiction.
