Funkin Cocktails 'Win Up To £25K Worth Of Prizes' On-Pack Promotion

TERMS AND CONDITIONS

Promoter: Funkin Limited, Crossley Drive, Magna Park, Milton Keynes, England, MK17 8FL

1. Promotion is open to all legal residents of the United Kingdom who are aged 18 or over, except employees of the Promoter or part of the A.G. Barr p.l.c. Group, their immediate family members, or anyone professionally associated with this promotion.
2. Purchase of a Promotional Product of Funkin Cocktails required. A device with internet browsing capabilities, internet access and email address required. A device with a QR scanner is optional.
3. Promotional Product: Funkin Cocktails included as promotional packs for the purpose of this promotion include (Promotional Product):
   • 700ml Funkin Cocktails Bottles in the following flavours: (i) Passion Fruit Martini, (ii) Pina Colada, (iii) Strawberry Daiquiri, and (iv) Lime Margarita; and
   • 8 x 200ml Funkin Nitro Can Cocktail Mixed Party Pack ( 2x Passion Fruit Martini, 2x Strawberry Daiquiri, 2x Peach on the Beach, 2x Pina Colada).
4. Maximum 1 entry per person. Maximum 1 entry per unique code.
5. Promotion Period: Opens at 00:01 on 1 May 2024. Closes at 23:59 on 31 August 2024. Any entries received outside the Promotion Period will not be accepted.
6. To participate: During the Promotion Period:
   • purchase any Promotional Product of Funkin Cocktails.
   • Scan the QR code on the neck collar on the Promotional Product, or visit www.funkincocktails-competition.co.uk; and
   • scratch the online scratch card displayed at www.funkincocktails-competition.co.uk; and
   • complete the entry form with your full name, email address and 8-digit unique code (found in Promotional Product neck collar) to see if you have won an instant prize and to enter the prize draw.
   • Participants will be notified immediately onscreen after the game if they have won an Instant Win Prize, which Instant Win Prize they have won, and how to claim their Instant Win Prize. All entries received during the Promotion Period will be submitted into the prize draw for the Prize Draw Prize.
7. Promotional Products are subject to availability and whilst stocks last.
8. Each 8-digit code is unique and can only be used once. Any attempts to enter the same code more than once, to use codes from non-promotional packs, or to use any codes not intended for use in this Promotion, may result in disqualification and all such entries will be void.
9. Instant Win Prizes: There are 428 Instant Win Prizes that are available to be won. Prizes that may be won are:

10. Instant Win Prize Conditions
    • All Instant Win Prize allocations are at the sole discretion of the Promoter, or their duly authorised agent.
    • Instant Win Prizes are subject to availability.
    • The Instant Win Prize Winner is unable to swap the Instant Win Prize allocated to them for another listed Instant Win Prize.
    • The Instant Win Prize Winner is expressly prohibited from selling or transferring the Instant Win Prize to another person.
    • The Promoter, or their duly authorised agent, shall provide details at the point of the Instant Win Prize notification regarding how the Instant Win Prize Winner can claim their Instant Win Prize.
    • The Promoter shall not be liable, and is under no obligation to replace an Instant Win Prize Winner, should the Instant Win Prize Winner provide incorrect or false details at the point of claim of the Instant Win Prize, which results in the Instant Win Prize Winner not receiving their Instant Win Prize.
11. Prize Draw Prize: 1 x 2 night trip for 2 to Barcelona. Prize includes:
    • 2 x economy return flights from London Heathrow or Gatwick;
    • double or twin accommodation at a minimum 4-star hotel with daily breakfasts;
    • private transfers to and from Josep Tarradellas Barcelona-El Prat airport;
    • a 90-minute cocktail experience at Paradiso bar in Barcelona;
    • Brunch with cocktails at a restaurant in Barcelona (to a maximum value of €50 per person including service charge); and
    • a 3-hour guided food and tapas tour of Barcelona.
12. Prize Draw Prize Conditions:
    • The Winner and their guest must have a valid passport to travel.
    • The Winner and their guest must meet all relevant visa and / or other entry requirements, including any medical / health screening requirement or similar, in advance of the trip and at their own expense.
    • All elements of the Prize must be taken at the same time;
    • Winner will be required to provide proof of age and identity and any documentation as reasonably required by the Prize Provider in order to validate their eligibility to claim the Prize;
    • Winner and guests must be over 18 years of age at time of travel;
    • Transport for excursions is provided.
    • Transport to the departure airport from the Winner's address shall not be provided. The Winner must make their own way and bear the relevant costs.
    • If the winner is unable to accept the Prize, no compensation will be provided;
    • Accommodation will be selected by the Prize Provider at their sole discretion;
    • Once a booking has been confirmed no changes are permitted;
    • A valid credit or debit card will be required for security deposit purposes when checking into hotel accommodation;
    • If a booking is cancelled no alternative tickets will be issued;
    • Travel bookings will be made via the Promoter's nominated agent and must be made at least 6 weeks in advance of proposed dates;
    • All travel is subject to the Prize Provider's standard terms and conditions. Once booked, travel tickets cannot be altered or amended and no refunds are possible;
    • Prize travel tickets cannot be used in conjunction with any loyalty programme, any other discount, discount coupon(s) or voucher(s), promotion(s) or special offer;
    • Once travel tickets have been issued, the Promoter shall not be liable for any failure to comply with its obligations caused by (but not limited to) weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, or any other circumstances beyond the control of the Promoter or travel companies;
    • The Promoter accepts no responsibility for any costs associated with the Prize that are not specifically and expressly included in the Prize. All such costs shall be borne by the Winner.
    • Specific excursions / trips included within the Prize Draw Prize are subject to availability. Should an aspect of the Prize Draw Prize not be available at the date of travel, the Promoter shall use their reasonable endeavours to provide an alternative excursion / trip of a similar value.
    • Basic travel insurance is included but winner should check the cover provided and obtain additional insurance if required (for example the provided travel insurance does NOT cover pre-existing medical conditions, or where winner or guest is over the age of 70).
    • Prize trip needs to be booked and taken within 12 months of winner being notified that they have won the trip.
    • Trip may not be taken between 21 December 2024 and 2 January 2025, Easter Sunday or UK bank holidays.
    • Winner and guest must be minimum 18 years old at time of trip.
13. Both the Instant Win Prizes and Prize Draw Prize are not transferrable and cannot be exchanged for cash. In the event of unforeseen circumstances, the Promoter reserves the right to substitute an Instant Win Prizes or Prize Draw Prize, or part thereof, for an alternative of equal or greater value.
14. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on acceptance of their Instant Win Prizes or Prize Draw Prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects the ability to acceptant or receive delivery of their Instant Win Prizes or Prize Draw Prize.

16. Instant Win Winner selection and notification: The 428 Instant Prize winners will be selected using an independently verified and audited algorithm process which will randomly determine if a participant has won based on the total number of promotional packs available during the Promotional Period and the expected redemption rate. There are a maximum of 428 Instant Win prizes to be won during the Promotion Period. Winners of Instant Prizes will be notified immediately on screen that they have won and will also receive an email.
17. Prize Draw Winner selection: All valid entries received by the Promoter during the Promotion Period will be submitted into a prize draw to be conducted under the supervision of an independent body within 5 working days of the end of the Promotion Period. One Prize Draw Winner and 1 reserve Prize Draw winner will be drawn from all valid entries.
18. Prize Draw Winner notification: The Winner will be notified by email to the account associated with the winning entry within 5 working days of date of the winner selection. The Winner must respond within 10 working days of the date of the notification email, confirming compliance with these Terms and Conditions and eligibility (age and residency). Failure to comply with this timeframe may result in disqualification of that Winner and the prize being awarded to a reserve. Entrants are encouraged to monitor their email account during this time in case they are a winner.
19. Instant Win Prize delivery: Physical prizes will be delivered by post or courier within 30 days of Winner confirmation of postal address. Voucher prizes will be sent by email to the email address associated with the winning entry. All Instant Prizes will be sent within 30 days of Instant Prize winner confirmation or supply of postal address, whichever is the later (as applicable).
20. Prize Draw Prize delivery: The Promoter or its agent will agree delivery with the winner by email or by telephone.
21. Unclaimed Prize Draw Prize: If despite the best efforts of the Promoter, the Prize Draw prize remains unclaimed after offering to 2 reserves, the Promoter shall not be obliged to allocate the prize but may withdraw it from the promotion.
22. Privacy: Participants' personal information will only be used for the purposes of administering this Promotion unless the participant has consented (by opting-in) to receive future marketing communications from the Promoter. The Promoter may share participants' personal data with Quantum who are an agency appointed by us to assist with the running of this Promotion and Prize fulfilment on our behalf, acting in capacity as a processor. 23. The surname and county of residence of the Prize Draw Prize will be available by sending an email to win@funkincocktails-competition.co.uk with “Funkin 25th Birthday Barcelona Winner" in the subject header, to arrive between 1 November and 28 February 2025. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting funkin@wearequantum.co.uk. In any case, if a regulatory body requests confirmation of the existence of winners, or evidence of receipt of prizes, the Promoter shall be entitled to disclose the information of any winner to the regulatory body only.
24. Participants in this promotion agree that neither the Promoters nor any of the promotional parties will have liability for: any faulty or failed electronic data transmissions; any communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers, human error or providers utilised in any aspect of this Promotion; any inaccessibility or unavailability of the internet or email services; any damage to prizes sent to participants; any non-delivery of prizes caused by the provision of wrong information by participants, postal disputes or other causes beyond the Promoter's control; or any system failures on the email services.
25. Insofar as permitted by law, the Promoters, its agents, and distributors will not in any circumstances be responsible or liable to compensate the winners or accept any liability for any loss, damage, personal injury or death occurring as a result of entering or taking up the Prize. Nothing in this clause shall limit the Promoter's liability in respect of: death or personal injury arising out of its own negligence; or liability arising out of the Promoter's fraud.
26. Entries (bulk or otherwise) made from trade, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of 'script', 'brute force', masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant's entries into the draw in a way that is not consistent with the spirit of the promotion, that person's entries will be disqualified and any prize award will be void.
27. The Promoter reserve the right to verify any claimant, including their age (via means of photographic identification), before awarding a Prize and refuse to award the Prize or withdraw Prize entitlement where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion.
28. Incomplete, illegal, misdirected or invalid entries, or entries not in accordance with these Terms and Conditions will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
29. If for any reason the Promotion is not capable of running as planned for reasons beyond the control of the Promoter (including but not limited to tampering, unauthorised intervention, fraud, technical failures) which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion), the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the running of the Promotion or to cancel, amend, terminate or temporarily suspend this promotion, with no liability to entrants or third parties.
30. The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant's entry to the promotion.
31. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
32. The Promoter's decision is final with regard to all promotional matters and no correspondence will be entered into.
33. These terms and conditions are governed by English law and shall be subject to the exclusive jurisdiction of the English and Welsh courts unless you live in another part of the UK, in which case your local courts will have jurisdiction.
