Terms & Conditions

These Terms and Conditions (the “Terms and Conditions”) govern your entry into and participation in the promotion. Please read these terms carefully before entering, as by entering, you are deemed to have accepted and agreed to be bound by these Terms and Conditions.

In the event of any conflict or inconsistency with any other communications related to the promotion, including advertising or promotional materials, these Terms and Conditions will take precedence. Please retain a copy of these Terms and Conditions for your information.

The Promoter takes data protection seriously. By entering this promotion, you confirm that you have read the Privacy Policy at https://www.mars.com/privacy and agree to any personal information you submit as part of this promotion being held and processed in accordance with this Privacy Policy, the UK General Data Protection Regulations (GDPR) and the Data Protection Act 2018. We may also share your details with our agent acting as prize fulfilment provider, as specified below.

ELIGIBILITY

1. This promotion is open to residents of the UK, excluding employees of the Promoter and their immediate families, affiliates, associated agents or anyone else professionally connected with the promotion.
2. Entrants must be aged 18 years or over at the date of entry.
3. Purchase is necessary. RETAIN PACK AND RECEIPT.
4. Internet access and registration required.
5. Bulk entries, entrants using multiple addresses, email addresses or entering via agents, third parties, organised groups, syndicates or aliases, or entries automatically generated by computer, will not be accepted. Entries received by any means other than as specified in these Terms and Conditions (see Condition 8 below) will be rejected. Any person persistently trying to circumvent the entry process will be disqualified immediately. No incomplete, corrupted entries or multiple entries from the same person beyond the daily limit will be accepted. The entry must be made directly by the person entering the promotion. Only genuine valid entries will be considered.

PROMOTIONAL PERIOD

6. Main Promotion Period: Enter between 00:00:00 on 22 April 2024 and 23:59:59 on 31 July 2024 for a chance to win a prize in the Main Promotion from the prize pool listed in Condition 14 below and also to be entered into a draw for a second chance to win. Entries must be received within the Promotional Period in order to be valid.
7. Wrap Up Draw Period: Enter between 00:00:00 on 1 August 2024 and 23:59:59 on 31 December 2024 to be entered in the Wrap Up Draw.

HOW TO ENTER FOR YOUR CHANCE TO WIN

8. For the chance to win, purchase a promotional pack or retail case of KIND®, EXTRA®, Mars®, Milky Way®, Galaxy®, Revels®, M&M’s®, Minstrels®, Maltesers®, Twix®, Ripple®, Snickers®, Starburst® or Skittles®, subject to retailer stock and availability.
9. Visit www.extragum.co.uk/winwin and complete the online registration form by entering your full name, email address, date of birth, and the requested digits of the barcode found on the outside of your pack or retail case.
10. Only valid entry information will be accepted, and the Promoter reserves the right to disqualify and reject any inappropriate entries. All entry information is subject to verification and interrogation. Entry information may not be sold or exchanged.
11. Packaging and your receipt should be retained following registration of the requested barcode digits, as it may be required to claim a prize.
12. In the event of suspicious activity, the Promoter reserves the right to request and gather information or obtain further evidence to confirm the legitimacy of the entry/win.
13. Only one entry per person, per day will be accepted. Anyone entering more frequently will be disqualified.

THE PRIZES

14. There are 7,111 prizes to be won during the Main Promotion and 1 prize to be won in the Wrap Up Draw. The prizes to be won are as follows:
    1. 10 Signed Football shirts.
    2. 100 x £100 Decathlon eGift cards to be used at any Decathlon store/online in the UK. eGift cards have an expiry of at least 18 months and are subject to the issuer’s terms and conditions that can be found here.
    3. 7,000 free packs of KIND®, EXTRA®, Mars®, Milky Way®, Galaxy®, Revels®, M&M’s®, Minstrels®, Maltesers®, Twix®, Ripple®, Snickers®, Starburst® or Skittles®.
    4. All entrants in the Main Promotion are also entered into a draw for the chance to win £10,000 in cash. The Promoter and £10,000 winner will also agree on a UK grassroots football organisation or charity to receive £10,000 funding.
    5. The Wrap Up Draw prize consists of 1 prize of £500 in cash. The Promoter and £500 winner will also agree on a UK grassroots football organisation or charity to receive £500 funding.
15. The UK grassroots football organisations or charities chosen to receive funding will be required to meet a set of due diligence criteria to ensure that funding is appropriately allocated to support grassroots football. Charities will need to be registered in the UK. The £10,000 and £500 draw winners will be fully consulted. If no agreement can be met between the winners and the Promoter, the Promoter’s decision is final regarding funding allocation.
16. There are 7,112 prizes in total, as detailed, that are available to be won throughout the entire promotion.
17. Prizes are strictly non-transferable and must not be sold, auctioned nor advertised for sale whether on the internet, in newspapers or elsewhere. Any person found in breach of this term will be disqualified from participating. No cash alternatives or other alternative prize will be available in whole or in part, except in the event of circumstances outside the reasonable control of the Promoter, whereby the Promoter reserves the right to substitute the prizes with prizes of equal or greater value. The prize will only be awarded directly to the winner. There is no limit on the number of prizes an entrant can win in the promotion.
18. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of the prize, the Promoter reserves the right to suspend the promotion or amend these Terms and Conditions, at any stage, with no liability to any entrants or third parties, but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.

WINNER SELECTION AND NOTIFICATION

19. Main Promotion Winner Selection: The prizes specified in Condition 14 of these Terms are guaranteed to be won (except if the number of prizes available exceeds the total number of valid entries received). With the exception of the two draw prizes, all prizes are pre-allocated via an open winning moments algorithm created by an independent third party. If your time of valid entry is the first to fall on or after a winning moment, you will be awarded a prize. If two entries are received at the same time, the entry processed by the server first will be the winning entry. Any prizes not won before the next winning moment will remain available until the next entry.
20. Main Promotion Winner Notification: Winners will be notified instantly on screen and via email and if appropriate will then be invited to provide additional details on the Website to receive the prize. If a winner consents, each winner’s name, email address, date of birth and, where applicable, postal address, will be shared with the Promoter’s agent, VCG The PromoRisk People Ltd., for administration of the prize.
21. Main Promotion Draw: All entrants who enter valid barcode digits at www.extragum.co.uk/winwin during the Main promotion Period will be entered into a prize draw for the chance to win £10,000 in cash.  The Promoter and £10,000 winner will also agree on a UK grassroots football organisation or charity to receive £10,000 funding.
    1. Main Promotion Draw Winner Selection: One winner will be picked in a random draw using an independently supervised process.
    2. Main promotion Draw Winner Notification: Prize winner will be emailed at the email address used to enter the promotion within 7 days of the end of the Main Promotion Period. The winner will be required to respond within 14 days confirming their acceptance of the prize and providing their name and address to receive the prize in the form of a cheque. If the winner consents, their name and contact details will be processed by the Promoter’s agent, VCG The PromoRisk People Ltd., for administration of the prize. In the event the winner does not respond to this notification within 14 days, the Promoter reserves the right to select an alternative winner from all remaining entries, with the originally selected winner forfeiting their right to the prize.
22. Wrap Up Draw: All entrants who enter valid barcode digits at www.extragum.co.uk/winwin during Wrap Up Draw Periods will be entered into prize draw to win £500 cash. The Promoter and £500 winner will also agree on a UK grassroots football organisation or charity to receive £500 funding.
    1. Wrap Up Draw Winner selection: One winner will be picked in a random draw using an independently supervised process.
    2. Wrap Up Draw Winner Notification: Prize winners will be emailed at the email address used to enter the promotion within 7 days of the end of the Wrap Up Draw Period. The winner will be required to respond within 14 days confirming their acceptance of the prize and providing their name and address to receive the prize by cheque. If a winner consents, their name and contact details will be processed by the Promoter’s agent for administration of the prize. In the event a winner does not respond to this notification within 14 days, the Promoter reserves the right to select an alternative winner from all remaining entries, with the originally selected winner forfeiting their right to the prize.
23. For the Main Promotion and Wrap Up Draws, the Promoter will make reasonable efforts to contact the winners and then, after successful contact, to receive the relevant information to allow fulfilment of the claim and arranging the prize dispatch. Regular reminder emails (up to 3) will be sent out to winners until they either redeem their prize in full or the Promoter forfeits the prize. Inaccurate information may result in the prize being forfeited. If a winner has not responded to notifications after 14 working days or if a selected winner is ineligible, otherwise in breach of these Terms and Conditions, or unable to take up the prize for any other reason, the Promoter reserves the right to withdraw the prize and to forfeit this original win and to reallocate the prize from all remaining entries if possible. Winners should retain their notification email message until their win has been verified.
24. Prize redemption: Winners of the £10,000 and £500 draw prizes will receive their prize by cheque sent via a Royal Mail Signed For service. Winners of a signed shirt prize will be required to provide their address details and will receive their prize by post to the address provided. Winners of a £100 Decathlon eGift Prize will receive their prize via email send to the email sent to the email address supplied by the winner at time of entry. Free pack winners will receive an email containing a unique link to a downloadable personalised free product coupon which can be redeemed against a pack from the list of products in Condition 8 above, up to a maximum value of £1.50, subject to availability of the winner’s preferred product at the time of coupon redemption. No change will be provided in the event that the chosen product costs less than £1.50 at the point of coupon redemption. Free product coupons can be printed only once, should not be forwarded to anyone else and will need to be redeemed within 30 days of printing. Only one coupon can be used per transaction. Attempts at multiple redemption of the coupon by the same winner or use by anyone else not intended to receive the link to the downloadable coupon may result in rejection of the coupon by a retailer and disqualification of that winner from further participation in the promotion. The link to the downloadable coupon will not expire until 31 October 2024.
25. Inaccurate information may result in prizes being forfeited. In the event that a selected winner is ineligible, otherwise in breach of these Terms and Conditions or unable to or declines to take up a prize for any other reason, the Promoter reserves the right to withdraw the prize and to select an alternative winner from all remaining entries.
26. Winners of all prizes apart from the signed shirt should allow 28 days from date of claim for receipt of their prize. Winners of a signed football shirt will be notified of an estimated delivery date, which will be subject to player availability. Signed shirt prize winners should allow up to 12 months for receipt of their prize.
27. The Promoter is not responsible for any entries which fail to be registered or are delayed for any technical or other reason whatsoever. The Promoter does not accept any responsibility in the event a winner is not able to take their prize for whatever reason, including in the event that a winner provides incorrect email address, postal address or due to postal delays or loss by the postal service.
28. Where prizes are to be delivered to the personal address of a winner, the prize will only be delivered to an address within the UK and will only be sent once. Should a prize winner's contact details change, it is their responsibility to notify the Promoter of such change.
29. Insofar as is permitted by law, the Promoter and its agents will not in any circumstances be responsible or liable to compensate entrants for any losses that may be incurred as a result of entering the promotion and the Promoter does not accept any liability for any loss, damage, personal injury or death occurring as a result of a winner’s acceptance of a prize except where such damage or loss is caused by the negligence of the Promoter or its agents. The winner’s statutory rights are not affected.
30. No correspondence: Winner selection is final and binding and no correspondence will be entered into, except with the prize winners.

GENERAL INFORMATION

31. A list of the cash prize winners’ surnames and counties is available on request. Please email your request to winwin@promotioncustomerservices.com within 3 months of the promotion close date. Should a winner object to their information being made available, they should contact the Promoter by emailing winwin@promotioncustomerservices.com. The Promoter may nevertheless disclose information to regulatory authorities if required by law to do so.
32. In the event a winner requests for their personal data including phone number and address details to be deleted before the expiry of this period, the Promoter cannot be held responsible if such request means that it is unable to complete delivery of the winner's prize or assist them following deletion of their name, email address and address details. The name and contact details of the winners will be retained for 30 days after the prize has been fulfilled to allow the Promoter to deal with any queries from the winner. Surname and/or county details may be retained and made available to members of the public in accordance with Condition 31.
33. Winners may be required if they consent to take part in reasonable publicity relating to this promotion without further remuneration.
34. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize/gift, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
35. The Promoter is not responsible for any entries which fail to be registered or are delayed for any technical or other reason whatsoever. The Promoter cannot be held responsible if the winner does not receive their prize as a result of having provided incomplete or inaccurate address details.
36. The Promoter reserves the right to verify the winning entries including by asking for the winner’s identity, including proof of age (which they must provide within 14 days but which will not be retained following verification by the Promoter and redemption of the prize) and may refuse to award a prize or withdraw a prize entitlement and/or refuse further participation in the promotion and disqualify a participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions (including entry requirements) or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.
37. The Promoter may at its absolute discretion disqualify any participant found to be tampering with the application process or operation of the website or to be acting in any manner disruptive to the promotion.
38. Sometimes, through reasons outside of the Promoters control, the website (as with any website) may not be accessible. The Promoter cannot guarantee continuous, uninterrupted access to the website. No responsibility will be accepted for any difficulties in entering, claiming or any entries/claims delayed or corrupted. The Promoter will have no liability for any loss arising out of such an event.
39. Limitations of liability: insofar as permitted by law, neither the Promoter nor the promotional parties assume any responsibility or liability for:
    1. Any faulty, incorrect, errors or failed electronic data transmissions;
    2. Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
    3. Inaccessibility or unavailability of the internet or the website or any combination thereof;
    4. Insofar as permitted by law, any injury or damage to participants or to any other person (or their property) which may be related to or resulting from any attempt to participate in the promotion.
40. If any clause of these Terms and conditions is determined to be illegal, invalid or otherwise unenforceable, then it shall be deemed deleted from these Terms and Conditions. The remaining clauses shall be unaffected and remain in full force and effect.
41. This promotion and these Terms and Conditions (and any disputes/claims arising out of or in connection with them) shall be governed by and construed in accordance with English law and the parties to any dispute or action shall submit to the jurisdiction of the English and Welsh courts. However, if you are resident in Scotland or Northern Ireland, you may bring your claim before the Scottish or Northern Irish courts (respectively), if you wish.
