Void where prohibited and subject to all federal, state, and local lawsThe competition is open to any person aged 18 and over, based either in Germany, France or the UK, apart from employees of Danone or its affiliates, parents, subsidiaries, divisions, suppliers, distributors and advertising, promotional and judging agencies and its affiliates, parents and subsidiaries, and each of their respective employees, shareholders, directors, officers, members and agents their immediate families and/or those living in the same household of each are not eligible to participate or anyone else connected with this competition.By participating to the competition, entrants will be deemed to have accepted and be bound by these terms and conditions. Volvic reserves the right to vary these terms and conditions at any stage. Volvic reserves the right to disqualify entrants that do not comply with these terms and conditions or participants whose conduct or content is inappropriate. In the event of any conflict between any terms referred to in such competition materials and these terms and conditions, these terms and conditions take precedence.Internet access and a personal valid Instagram account are required. Entry The competition starts at [9am EST, 3pm Germany and France CET, and 2pm UK BST] on 19th July 2023 and participations must be received by no later than 11:59pm on 24th July 2023. The competition will be open through @beautifuldestinations Instagram account and supported by Volvic’s own channels.To enter the competition entrants must:(i) Visit @beautifuldestinations Instagram account from [9am EST, 3pm Germany and France, and 2pm UK ] on 19th July (“Authorized Account”)(ii) Follow @volvic Instagram account (and @beautifuldestination if you do not follow already)(iii) Like the post relating to the Source Destination competition (iv) Tag a friend in the comments (1 tag = 1 entry, enter as many times as you wish)Any friends tagged in the comments section of the post as set out must have individual Instagram accounts (no company accounts or animals for example) be aged 18 and over and based either in France, the UK, Germany.(v) Bonus: Share the post relating to the Source Destination competition to your stories for an additional entry, and be sure to tag @volvic and @beautifuldestinations The competition is not operated by Instagram, participants acknowledge and agree that they cannot hold Instagram liable for any damages arising in connection with the competition. Participants' Instagram accounts must be set to open mode.Participation is personal. It is forbidden to play from another person's Instagram account.The comment must not contain any inappropriate, indecent, obscene, hateful, pornographic, violent or defamatory content. It must not contain content that promotes bigotry, racism, hatred or violence towards any group or person, the promotion of discrimination on the basis of race, gender, religion, nationality, disability, sexual orientation or age. The commentary/picture/picture/video must not contain nudity or depict alcohol or tobacco products. The content of the commentary must comply with the law, not infringe on the rights of third parties and be accessible to all audiences. Any comment that does not comply with the conditions of participation described in these rules will be excluded from the competition, without Volvic having to justify itself to the participant concerned or to the other participants.Completion of the above criteria will constitute a valid entry into the competition. Only one participation to the competition per person is authorized. Entrants using multiple Instagram accounts to participate to the competition will be disqualified. The winner There will be one (1) winner selected from the entries.The draw on the Authorized Account will take place on 25th July 2023 and the winner will be chosen shortly after closing. The winner will be chosen at random from all complete, eligible, properly submitted participations received before the end of the closing date. Volvic will make reasonable efforts to contact the winner by direct messaging their Instagram account within 24 hours to give full details about how to get the prize. Volvic will provide the winner with a consent form to be completed, signed and sent back by email to Volvic to validate and move forward with prize fulfilment for the winner If any e-mails or messages to the winner is unanswered within 48 hours from reception / returned as undeliverable / the winner refuses or are unable to provide eligible information or claim the prize in the timeframe, Volvic reserves the right to select an alternative winner to award its prize.The chosen winner will redeem the Source Destination competition prize for them and their chosen participant. Two people maximum can redeem this prize. The winner will receive a direct message from @volvic to notify them that they’ve won.The winner will be required to submit valid identification before redeeming their prize and provide evidence proving that, to the reasonable satisfaction of Volvic, they meet the criteria to be considered a winner.The prize needs to be redeemed between 11th to 13th September 2023.Winner undertakes not to publicly jeopardize or threaten the image of Volvic or Danone or Beautiful Destinations. Prize The winner will win a once in a lifetime opportunity to stay in a mini home concept that blends the indoor and outdoor space through mirrored glass (hereinafter “The mini home”), offering panoramic views of the vast landscape of the Chaine Des Puys Volcanoes in the Auvergne-Rhône-Alpes, France. The two-night stay will also include a rich itinerary of activity (a good physical condition is required) for the winner and their plus one to enjoy. The winner undertakes to respect the mini home and to return it in the condition in which the winner found it. If so, the winner will be responsible for any damage.In the event that the winner does not wish or is unable, for any reason whatsoever, to benefit from the prize won, under the conditions described in these T&C, he shall lose the full benefit of said prize and may not claim any compensation or consideration in cash. Volvic reserves the right to select an alternative winner to award the prize or Volvic may freely dispose of it. The prize may not be taken back at the request of the winner for its cash value, nor may they be replaced by other prizes. Volvic reserves the right to replace the prize with prize of similar characteristics and equivalent or greater value if circumstances so require. The prize is personal and may not be transferred.Any prize that is returned to the Volvic team, for any reason whatsoever (for example: no longer lives at the address indicated) shall be deemed to have been abandoned by the winner and shall not be put back into play by Volvic. Volvic shall not be required to make any additional inquiries. Any prize not claimed within two months after the closing date of the competition shall be deemed to have been abandoned by the winner and shall not be put back into play by Volvic.The winner must be aged 18 and over, based either in Germany, France, or the UK. Valid identification/passport will be sought by Volvic.Volvic will cover flight travel to the Source Destination for the winner and its plus one up to the value of £1,000 or the equivalent in euros. Transfers to and from departure airport [or rail station] will be of the responsibility of the winner. Transfer from to and from Lyon or Clermont- Ferrand airport, or train station, to the Source Destination will be managed by Volvic.By participating in the competition, participants and the winner agrees that each prize is awarded on an "as is" basis, and that neither Volvic nor any of its subsidiary or affiliated companies, make any representations or warranties of any nature with respect to the prizes.The winner is responsible for paying all associated costs that are not specifically mentioned in these terms and conditions, including (where applicable) taxes, insurance, additional food, and drink not provided in the prize and all other incidentals.GeneralThe winner will be contacted by the Volvic global Instagram account via direct message. Volvic reserves the right to terminate, amend or extend the competition.The prize is as stated and there are no alternative prizes or a cash substitute. The prize is non-transferable.Volvic does not accept liability for any losses or claims arising out of the competition except in cases of personal injury or death resulting from its own negligence. Save where it has been negligent, Volvic will not be responsible for any damage, loss or injury resulting from entries or winner’s entry into the competition or their acceptance and/or use of a prize, or for technical, hardware or software failures, lost, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit their ability to enter the competition. Nothing in these terms and conditions shall in any way limit Volvic's liability for death or personal injury caused by its negligence or for any other matter where liability may not as a matter of law be limited.PARAGRAPHS 22 AND 23 CONTAIN DATA PROTECTION WORDING – PLEASE READ CAREFULLYVolvic will collect, and process participants' and winner’s personal information only to the extent necessary to select the winner. If entrants or the winner do not provide any of the mandatory information requested when entering and taking part in the competition, they will not be eligible to win the competition. Entrants and winners’ names and other personal details from their entry to the competition will be collected and stored by Volvic and its affiliates (including those outside the European Economic Area) and held in accordance with the applicable privacy policy in place from time to time (see https://www.volvic.co.uk/privacy-policy) Neither Volvic nor any of its subsidiary or affiliated companies are responsible for any condition, circumstances, losses, failures or delays caused by events beyond its or their control such as (but not limited to) the acts or defaults of any supplier selected by Volvic to provide the prize or otherwise that may cause the competition prize to be disrupted or corrupted or that may lead to loss or damage of a prize in transit to a winner.This competition is not sponsored, endorsed, or administered by, or associated with Instagram. By entering this competition, all participants release Instagram from any liability arising out of this competition.Volvic’s decision is final, and no correspondence will be entered into.This competition is governed by French law. The courts of France shall have exclusive jurisdiction to hear any dispute or claim arising in association with the competition or these terms and conditions.
