COMPETITION TERMS AND CONDITIONSPlease read these Terms and Conditions (the "Terms") carefully. You will be legally bound by these Terms from the time you submit an entry for the Cadbury Find a Golden Token promotion (the Promotion).The Promoter and the AgencyPremier Foods Group Limited of Premier House, Centrium Business Park, Griffiths Way, St. Albans, United Kingdom, AL1 2RE is the "Promoter".20Ten Creative Limited of Fourth Floor, Old Street Works, 197 City Road, London, EC1V 1JN is the "Agency"EligibilityThe Promotion is open to residents of the UK and ROI, aged 18 or over. This Promotion excludes employees of the agents (including the Agency) and employees of the Promoter and its group companies, the families of such agents and employees, or anyone professionally connected with the Promotion or its administration.Entrants may need to provide proof of name, age and address to validate that they meet the entry requirements and can accept the prize.Purchase of a Cadbury Find a Golden Token promotional pack ("Promotional Pack") required for UK residents only. Please retain Promotional Pack, purchase receipt and, if applicable, Golden Token, as these may be required for entry and / or to validate a claim for a prize. See paragraph 15 for list of Promotional Packs. No purchase is required for ROI residents (see No Purchase Required Entry Route for ROI Residents below).Internet access and valid email address required (and telephone number for ROI residentsGolden Token Promotion - How to EnterThe Promotion will begin on 15 May 2023 (the "Opening Date") and will close on 25 August 2023 (the "Closing Date"). The period from the 00.00am on the Opening Date and expiring at 11.59pm on the Closing Date is the promotion period (the "Promotion Period").To participate in the Promotion, you will need to:During the Promotion Period, purchase a Cadbury Find a Golden Token Promotional Pack (no purchased is required for residents of ROI (see No Purchase Required Entry Route for ROI Residents section below); andOpen the Promotional Pack to see if you have won a golden token containing a unique code and a specified cash prize amount of either £1000, £100 or £10 (the "Golden Token"). Golden Tokens will be placed in the cardboard tray of the Promotional Pack.If you find a Golden Token in your Promotional Pack, then you have won a prize (see Golden Token Prizes section below for details). To claim your prize, you will need to, by no later than 4.30pm on 5 September 2023 (the "Prize Claim Deadline") visit www.findthegoldentoken.co.uk (the "Website") and follow the instructions to submit your contact details (including your full name, email address and residential address), the unique code from your Golden Token and, to upload a picture of your Golden Token and your purchase receipt.The Agency will review prize claims submitted in accordance with paragraph 9 to verify that the claims are valid and comply with these Terms. Once a prize claim has been verified, the winner will receive a Winner Confirmation Email with details on how to arrange payment of their prize (see Winner Confirmation Email below). Please allow 5 working days for your prize claim to be reviewed and for receipt of the Winner Confirmation Email (you may need to check your junk email).Golden Tokens with Promotional Products purchased after the Closing Date and / or any prize claims not submitted by the Prize Claim Deadline will be invalid.The photograph of your Golden Token submitted with your prize claim in accordance with paragraph 9 should show the whole Golden Token clearly, including the unique code appearing on the Golden Token. The photograph of your purchase receipt with your prize claim in accordance with paragraph 9 or, your Wrap Up Draw entry (see Wrap Up Draw below for detail), as applicable, must show the whole receipt clearly, including the date of purchase and the promotional product purchased. Files will need to be in JPG, PNG or GIF format, up to a maximum size of 10MB. Failure to comply with these requirements may result in a delay to your prize claim or, your prize claim or entry becoming invalid, if you are unable to comply with these requirements.Where a prize claim in the Golden Toke Promotion becomes invalid pursuant to these Terms, then the prize will be added to the Wrap Up Draw (see Wrap Up Draw section below for details).If you do not find a Golden Token, then you can still enter the Wrap Up Draw (see Wrap Up Draw below).The following Promotional Packs will be available in participating stores, subject to availability:Cadbury Milk Chocolate Mini Rolls (5 pack);Cadbury Raspberry Mini Rolls (5 pack);Cadbury Milk Chocolate Mini Rolls (10 pack);Cadbury Raspberry Mini Rolls (10 pack);Cadbury Crunchie Cake Bars (5 pack);Cadbury Milk Chocolate Cake Bars (5 pack);Cadbury Caramel Cake Bars (5 pack);Cadbury Fudge Cake Bars (5 pack);Cadbury Chocolate Mint Mini Rolls (5 pack); andCadbury Chocolate Orange Mini Rolls (5 pack);Only selected Promotional Packs, selected at random will contain a Golden Token. The process to randomly distribute Golden Tokens in Promotional Packs has been verified by an independent agency.Winner Confirmation EmailAll winner confirmation emails (the "Winner Confirmation Email") will be sent from the following email address: help@findthegoldentoken.co.uk. Please make sure that you check the email address carefully, to ensure that the email is genuine. The email will include a link to a secure prize claim form (the "Prize Claim Form") where the winner will be asked to submit their contact details (including their full name, email address and residential address). The details provided should match the contact details provided with the winner’s entry. The winner will be asked whether they want their prize to be paid by BACS or cheque. Where winners have selected payment of the prize by BACs, the winner will be asked to provide their full name, account number and sort code in the Prize Claim Form. The name on the bank account provided will need to correspond with the name given in the winner’s entry. We will NEVER ask for the sixteen-digit card number appearing on the front of your debit or credit card, card start date or expiry date or, the three-digit secure number on the back of your card.Winners will need to complete the Prize Claim Form received in accordance with paragraph 16, within 10 working days of the date of the email. If you do not submit the form within this time, then your claim will become invalid. The Agency may, at its discretion, make up to two attempts to resend the Winner Confirmation Email or, send a follow up email to the winner if it does not receive a response.Where any prize claims in the Golden Token Promotion become invalid, then the prizes will be added to the prize pool for the Wrap Up Draw (see Wrap Up Draw below for details). Where any prize claims in the Wrap Up Draw become invalid, then the Promoter reserves the right to select an alternative winner, at random, via a computer-generated randomiser, from all remaining eligible entries in the Wrap Up Draw.No Purchase Required Entry Route for ROI ResidentsNo purchase is required to participate in the Golden Token Promotion for residents of the ROI. If you live in the ROI, then to participate in the Promotion you need to:By no later than 4.30pm on the Closing Date, contact our freephone customer services number: (0) 808 1754105 where a member of the Agency’s customer services team will assist you with your entry. Alternatively, if you contact the telephone number available on the Promotion Pack or on any other marketing materials, then you will be required to select the Cadbury competition option and we will redirect your call to the Agency;Provide your full name, residential address, phone number, and email address to participate; andThe Agency will open a Promotional Pack on your behalf, to find out if you have won a Golden Token.(the "Phone Entry").Please note, phone entries will be recorded by the Agency for the purpose of recording consents and for monitoring purposes.Phone Entry maximum entries: For Phone Entries there is a maximum of one entry per phone call and a maximum of five entries per household, per week. Only one Promotional Pack will be opened during a Phone Entry.If you win a Golden Token: The Agency will confirm during the Phone Entry, whether you have won a Golden Token and, if you have won, the prize cash amount won. Following the Phone Entry, winners of a Golden Token will be sent a Winner Confirmation Email (see Winner Confirmation Email above). Please allow 1 day to receive the Winner Confirmation Email (you may need to check your junk email).If you do not win a Golden Token: If you do not win a Golden Token, the Agency will ask whether you would like to opt in to receive details on the Wrap Up Draw and how to enter, by email. See Wrap Up Draw below for details on the Wrap Up Draw. If you consent, you will receive an email with details on the Wrap Up Draw and, an entry form ("Wrap Up Draw Email"). If you choose not to receive the Wrap Up Draw email, then neither the Promoter, nor the Agency will contact you.Phone Entries can only be made during the consumer careline opening times which are between 9am and 5pm, Monday – Friday.The customer-services number for ROI Promotion entries is a free-phone phone number however, charges from network providers may apply. Please check with your network provider and ask bill-payer’s permission.The Agency will be provided with a number of Promotional Packs, based on the estimate number of Phone Entries it expects to receive during the Promotion Period and for the Agency to open during a Phone Entry. The product type and flavour variants of Promotional Packs sent to the Agency have been determined by a computer-generated randomizer (for example 10 x Cadbury Caramel Cake bars, 20 x Cadbury Milk Chocolate Mini Rolls etc.). A computer-generated randomiser has also been used to determine which order the Agency will follow to open a Promotional Product (by product type and flavour variant) (the "Product-Opening Order List") during Phone Entries. If a product type or variant is not available to the Agency at the time of a Phone Entry due to availability, then the Agency will open the next available product type and flavour variant Promotional Product listed on the Product-Opening Order List.Golden Token PrizesPrizes: There will be 1,107 Golden Tokens available to be found during the Promotion Period, randomly allocated to Promotional Packs. Each Golden Token contains a specific cash prize amount and a unique code. The following cash prizes are available to be won:9 x £1000*99 x £100*999 x £10** Winners who are residents of the ROI will receive the equivalent cash prize amount in Euros, based on the applicable exchange rate at the time of transfer.There is no guarantee that all Golden Tokens will be found, or prizes will be won or claimed in accordance with these Terms. Any prizes not won or claimed in accordance with these Terms will be added to the prize pool for the Wrap Up Draw (see Wrap Up Draw below).Wrap Up DrawWhere a participant in the Promotion does not (i) with their purchase (not required for ROI resident) or (ii) Phone Entry (for ROI residents), win a Golden Token, then they will have the option to submit an entry into the wrap up draw (the "Wrap Up Draw") for each non-winning purchase or, non-winning Phone Entry (subject to the maximum restrictions in paragraph 31).If you purchase a Promotional Pack during the Promotion Period and do not find a Golden Token, then you can enter the Wrap Up Draw by:During the Promotion Period, visiting the Website and following the instructions to submit an entry into the Wrap Up Draw by entering your contact details (including your full name, email address and residential address) and, by uploading a photograph of your purchase receipt. The photograph of your purchase receipt must meet the requirements in paragraph 12.If you are a resident of ROI and opted in to receive the Wrap Up Draw Email at the time of your Phone Entry (see paragraph 22) then you will be sent an email within 2 hours of completion of the Phone Entry, with details on the Wrap Up Draw and an entry form. To enter, you will need to:During the Promotion Period, submit your contact details (including your full name, email address, phone number and residential address) via the entry form in the Wrap Up Draw Email. These details should correspond with the details provided in your non-winning Phone Entry.Please note, if you make your Phone Entry and do not win a Golden Token and, you have opted in to receive details on the Wrap Up Draw, then you will have until the 11.59pm on the Closing Date to submit an entry into the Wrap Up Draw (in accordance with paragraph 30). Please bear this in mind if you make your Phone Entry on or near to the Closing Date.Maximum entries in the Wrap Up Draw: There is a maximum of one entry into the Wrap Up Draw per (i) Promotional Product purchased with no Golden Token or, per non-winning Phone Entry for ROI residents and (ii) a maximum of five entries per household, per week, during the Promotion Period.Wrap Up Draw PrizesThere will be a minimum of the following prizes available to be won in the Wrap Up Draw:1 x £1000*1 x £100*; and1 x £10*plus, any prizes not won, claimed, or which otherwise cannot be awarded in the Find a Golden Token Promotion, will be added to the prize pool for the Wrap up Draw (the "Wrap Up Draw Prize Pool")* Winners who are residents of the ROI will receive the equivalent cash prize amount in Euros, based on the applicable exchange rate at the time of transfer.Selection of Wrap Up Draw WinnerBy no later than the 6th October 2023, one winner will be selected at random for each available prize in the Wrap Up Draw Prize Pool. Wrap Up Draw winners will be selected at random from all eligible entries into the Wrap Up Draw, via a computer-generated randomizer.Wrap Up Draw Winner Announcement and Prize DeliveryWinners of the Wrap Up Draw will be contacted via email by no later than 27th October 2023 that they have won a cash prize and, the cash prize amount won. Entrants who have not won the Prize will not be notified. Winners will be sent a Winner Confirmation Email (see Winner Confirmation Email above). Winners will need to submit their prize claim in accordance with paragraph 16 and in accordance with the timescales in paragraph 17). Failure to submit the prize claim accordingly will invalidate the prize claim and, the Promoter shall reserve the right to select an alternative winner, at random, via a computer-generated randomizer, from all remaining eligible entries in the Wrap Up Draw.Additional Prize Terms (applicable to Golden Token Promotion and the Wrap Up Draw)Delivery of Prizes: Where winners select to have a cash prize paid by cheque, then the cheque payment will be made out to the name of the winner and will be sent to the residential address provided in the Prize Claim Form (see paragraph 16) within 28 days of the winner submitting the Prize Claim Form. Where winners select to have a cash prize paid by BACS, then the applicable cash prize amount will be transferred to the winner’s account details provided in the Prize Claim Form (see paragraph 16) within 28 days of the winner submitting the Prize Claim Form. Winners who are residents of the ROI will receive the equivalent cash prize amount to the sterling cash prize sum in Euros, based on the applicable exchange rate at the time of transfer.The Promoter reserves the right (but is not obliged) to substitute a reasonably equivalent alternative prizes of equal or greater value, should circumstances make this necessary.Prizes are not negotiable or transferable.Where prizes are sent by post, the winner or an individual aged 18 or over nominated by the winner, will be required to be available at the delivery address to accept and sign for delivery of the prize.Data Protection and MarketingWhere entrants are required to create and submit content to enter the Promotion, the entrant warrants that its entry and the materials submitted with its entry will not infringe the intellectual property rights (including copyright) or, any other proprietary rights whatsoever of any third party.All entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned. By submitting your entry and any accompanying material, each entrant agrees to:assign to the Promoter all intellectual property rights in your competition entry and any accompanying material with full title guarantee; andwaive all moral rightsin and to their entry and otherwise arising in connection with their entry to which the entrant may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world. Each entrant agrees that it shall execute any document or instrument necessary to give effect to any assignment, grant of rights or waiver referred to in this paragraph.By entering the Promotion, each entrant agrees that any personal information provided by them with their entry may be held and used by the Promoter or its agents (including the Agency) and its suppliers for the purpose of administering the Promotion. Please see the Privacy Policy for more information on how your personal data will be handled.The Winner may be required to take part in non-paid publicity or advertising relating to the Promotion, which may include having their photograph taken for promotional and press purposes. The Promoter may use the Winner’s title, surname and county of residence to announce them as the Winner of the Promotion. If you do not wish for your personal information to be used for any of the reasons set out in this paragraph or, if you wish to limit the amount of personal information that is published, please contact the Promoter’s Data Privacy Team at privacy@premierfoods.co.uk (if you live in the UK) or on privacyeu@premierfoods.eu (if you live in the ROI).To receive a list of Winner(s) and county of residence of the Winner(s) please contact our consumer careline team at 0800 032 7111 (for UK) or 1800 93 2814 (for ROI) or by completing our online Contact Us Form at: https://www.premierfoods.co.uk/contact-us. Requests must be made by 31st January 2024. Please note that we may not be able to disclose this requested information, if an entrant objects to the disclosure of such information in accordance with paragraph 42. Where a winning entrant has objected to their information being disclosed, the Promoter or the Agency will instead confirm that a valid award has taken place.Limitation of LiabilityInsofar as is permitted by law, the Promoter, its agents (including the Agency) or distributors will not in any circumstances be responsible or liable to compensate the winner(s) or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.GeneralBy entering the Promotion, you are agreeing to be (i) bound by these Terms and, (ii) to the extent applicable, the Premier Foods Group Limited website general terms of use: https://www.premierfoods.co.uk/SpecialPages/Legal-Notices/LegalNotices-TermsOfUse.aspx; and all other applicable terms on the site and (iii) that you are aware of the Privacy Policy. Any entries that do not comply in full with these Terms, the applicable terms set out in this paragraph or which are otherwise not in accordance with the spirit of this Promotion, at the Promoter’s discretion, will be disqualified.Entries made through agents, third parties, organised groups or any entry duplication method will not be accepted.Any decision of the Promoter as to eligibility to take part in the Promotion or the result of the Promotion will be final and no correspondence or discussion will be entered into. The Promoter accepts no responsibility for entries that are incomplete, delayed, lost, damaged or unreadable whether due to failure or non-availability of the website, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind, or the submission of incomplete information or any other reason.The Promoter reserves the right to delay, postpone or cancel the Promotion in the event of circumstances outside its reasonable control, which it considers necessary.The Promotion and these Terms are subject the laws of England and Wales.
