TERMS & CONDITIONS –ON-PACK PRIZE PROMOTION.These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the Terms and Conditions. Please retain a copy for your information.1. THE PROMOTER KP Snacks Limited, Fifth Floor, The Urban Building, 3-9 Albert Street, Slough, SL1 2BE.2. ELIGIBILITY This prize draw (the “Promotion”) is open to UK (England, Wales, Scotland and Northern Ireland) residents aged 18 years or over at the time of entry only excluding employees of the Promoter and their immediate families, the Promoter’s agents, third parties or any other person professionally connected with the Promotion. The Promotion is not open to residents in Republic of Ireland, the Isle of Man or the Channel Islands.3. Internet access required to enter. No purchase necessary.4. This Promotion features across 8 of the Promoter’s brands (KP Nuts, Skips, Hula Hoops, Pom-Bear, Popchips, Butterkist, Tyrrells, McCoy’s) with one shared prize pool.5. THE PROMOTIONAL PERIODa. The “Main Promotion Period” will begin at 00:01 on 1st May 2023 (the “Opening Date”) and will end at 23:59 on 20th August 2023 (the “Main Promotion Period Closing Date”). There is one prize draw a week for 16 weeks within the Main Promotion Period.b. The Late Entry Draw (the “Late Entry Draw”) is for all entries received between 00:00 on 21st August 2023 and 23:59 12th November 2023 (the “Late Entry Draw Closing Date”). All entries received after the Late Entry Draw Closing Date will be disqualified.6. HOW TO ENTER:a. Go to everyonein.co.uk/pitches.b. Enter your name, residential address, valid email address and phone number.c. Only one (1) entry is permitted per person per week. For the avoidance of doubt, only one entry per person per week will be accepted, and a person can use only one name, address, email address and phone number to enter per week during each Weekly Prize Draw, or once during the Late Entry Draw period.7. ADDITIONAL DETAILS FOR ALL ENTRANTSa. Any entrant or household using multiple email addresses, multiple postal addresses, phone numbers or multiple names to access the Promotion will be disqualified and any prize will be void. The Promoter reserves the right to determine, in its sole and absolute discretion, whether a participant or household has already submitted an entry (or won a prize) and to disqualify any subsequent entries or prize claims.b. Entrants must have internet access to enter the Promotion. The entrant is reminded to get the owner's permission before using a computer, device and/or internet-access which is not owned or paid for by the entrant to enter the Promotion. The Promoter will not be liable for any internet, or mobile connection, or other charges incurred in entering the Promotion.c. Proof of sending will not be accepted as proof of delivery or receipt of entry. Incomplete, illegal, misdirected or entries received outside of the applicable Promotion Period will not be accepted, and you will not be entered into the Promotion.d. No third party or bulk entries. Do not enter on behalf of another person. Entries via third parties, consumer groups or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these Terms and Conditions in full will be disqualified. If it becomes apparent in the reasonable opinion of the Promoter that any entrant or the entrant’s household is using any means to circumvent this condition such as, and without limitation, fraudulently falsifying data, using identities other than their own, using any other automated means in order to increase that entrant's entries, or otherwise acting dishonestly, fraudulently or otherwise in violation of these terms, such entrant will be disqualified, and any prize entitlement will be void.e. Proof of purchase will not be accepted as proof of entry. No responsibility can be accepted for entries that are incomplete, lost due to technical reasons, corrupted, delayed or not received for whatsoever reason.8. MAIN PROMOTION PERIOD WINNER SELECTIONa. There are 96 x £100 prizes (each a “Prize”) available to be won during the Main Promotion Period. 6 winners will be drawn by a random computer generator from all eligible entries received within a Weekly Prize Period. Each draw will take place within 14 days of each Weekly Closing Date.b. A household can win a maximum of one Prize throughout the Main Promotion Period.9. LATE ENTRY DRAW DETAILS & WINNER SELECTIONa. Subject to clause 9f below, entries received between 00:01 on 21st August 2023 and 23:59 12th November 2023 (the “Late Entry Draw Closing Date”) will be entered into a random draw to win £100 (the “Late Draw Prize”).b. There are 10 x £100 prizes each a Late Draw Prize.c. The winners of a Late Draw Prize will be the first ten entrants selected by a random computer generator from all eligible entries after the Late Entry Draw Closing Date.d. Only one entry per person.e. Only one Late Draw Prize per household.f. Participants awarded a Prize during the Main Promotion Period are not eligible to win in the Late Draw Prize.10. WINNER VERIFICATION AND PRIZE FULFILMENT FOR ALL WINNERSa. All Prize winners will be contacted within 14 days of the Weekly Closing Date and Late Prize winners will be contacted withing 14 days of the Late Entry Draw Closing Date via the email address provided at the point of entry and will be asked to provide valid proof of residential postal address provided at the point of entry and proof of name and age with valid ID matching the entry name (only official documents can be accepted as proof of ID (passport, driving licence, council tax bill, utility bill less than three months old or bank statement, for example) and to confirm how they would like to receive their cash prize via cheque or BACS. Winners that choose a BACS transfer will need to provide a valid UK bank account number and sort code. Business or work addresses will not be accepted. Out of date proof of identity or address will not be accepted. A mobile phone bill will not be accepted as proof of address. Please note we can only send and receive emails to and from the address given at the point of entry to confirm the information required in this paragraph.b. If any winner declines a prize or fails to respond within 7 days of receipt of email, or is unable to provide the correct proofs, they forfeit any right to the prize.c. The Promoter reserves the right to verify all winners including proof of name, age and address and to request ID. The Promoter may withdraw prize entitlement where there are reasonable grounds to believe there has been a breach of these Terms and Conditions.d. It is the responsibility of the entrant to provide their correct, up-to-date details when entering the Promotion and/or confirming acceptance of any prize in order for their prize to be processed. The Promoter accepts no responsibility for entrants or winners failing to supply accurate information which affects any acceptance and/or delivery of any prize.e. The Promoter reserves the right to replace a prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.f. All prizes are non-transferable and non-exchangeable.g. The Promoter does not accept any responsibility in the event a winner is not able to take their prize.11. LIMITATION OF LIABILITYa. Insofar as is permitted by law, the Promoter and its agents will not in any circumstances be responsible or liable to compensate entrants for any losses that may be incurred as a result of entering the Promotion and the Promoter does not accept any liability for any loss, damage, personal injury or death occurring as a result of a winner’s acceptance of a prize except where such damage or loss is caused by the negligence of the Promoter or its agents.12. PUBLICITY AND DATA PROTECTIONa. Any personal information that entrants share with the Promoter will be kept secure and only used in line with these Terms and Conditions and the Promoter’s privacy policy. By entering the promotion, entrants agree that their information may be used by the Promoter to administer the promotion. Entrants' personal data will be used and will be held in accordance with the Promoter's Privacy Policy, which is available here: everyonein.com.b. The surname and county of prize winners will be made available to anyone who requests them by emailing winnerlist@kpcricket.co.uk within 1 month of the Late Draw closing date Winners may request their surname and county are not published in the event they win by emailing help@kpcricket.co.uk before the closing date save that disclosure to regulatory authorities may still be required.c. Winners may be asked to take part in reasonable publicity without payment. Such publicity may include, without limitation, using a winner’s name and, if relevant, their image and any statements made by them concerning the Promotion and the prizes won as part of the Promotion. The Promoter will not use an entrant’s personal data for publicity purposes without the entrant’s consent. This does not prevent the Promoter from disclosing the winner’s surname and county of residence in accordance with paragraph 12b of these Terms and Conditions.13. GENERALa. Any unclaimed prizes, or prizes withdrawn for whatsoever reason, will be reallocated via a prize draw. Winners will be selected by a random computer generator by 24th November 2023 from all entrants to the Main Promotion Period and Late Prize Draw and notified in accordance with the process set out in clause 10.b. Promoter’s decision is final and binding in relation to all matters relating to the Promotion. No correspondence will be entered into.c. By entering this Promotion an entrant agrees to be bound by these Terms and Conditions.d. Instructions provided at the point of entry form part of the Terms and Conditions of this Promotion. In the event of a conflict, these Terms and Conditions take precedence.e. Whilst the Promoter will take all reasonable steps to ensure that its obligations relating to meeting specific timeframes for prize dispatch are met, the Promoter shall not be liable in any way for its inability to meet these timeframes resulting from an outbreak of Covid-19 either within its own business or within the prize delivery supply chain.f. Should Covid-19 affect the Promoter’s ability to meet these deadlines, it will fulfil its obligations as soon as is reasonably possible after its and/or its third-party fulfilment providers resume business as usual.g. The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these Terms and Conditions or the spirit of the Promotion. Those who try to circumvent the entry process and/or entry instructions by any method, will be disqualified and any prize award will be void.h. The Promoter reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this Promotion in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties but will use all reasonable endeavours to avoid consumer disappointment. Such circumstances include, but are not limited to: industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of the Promoter.i. The Promoter takes no responsibility for entries that are delayed, incomplete or lost due to technical reasons or otherwise.j. The Promoter accepts no responsibility for system errors or other issues that may result in disruption to winner notifications or prizes. The Promoter or its agencies will not be responsible for the non-inclusion of entries, including any such failure which is within the control of The Promoter or its agencies.k. If any clause or provision of these Terms and Conditions is declared by a court to be illegal, invalid or unenforceable, this declaration shall not affect the validity and enforceability of any other clause or provision withinm. These Terms and Conditions shall be governed by the laws of England and Wales and the parties irrevocably submit to the courts of England and Wales which shall have exclusive jurisdiction in relation to any dispute concerning them.
